Please read these Terms of Use (“Terms”) carefully before using Acuna. By downloading, accessing or using the Acuna application (“Acuna”, “the app”), you agree to these Terms. If you do not agree, do not use the app.
Acuna is published by Atlander, Unipessoal, Lda, registered in Portugal (NIF/NIPC 516934473), Avenida Valbom 17, 2.º D, 2750-508 Cascais, Portugal (“Atlander”, “we”, “us”). Contact: support@acuna.app.
1. Who may use Acuna
Acuna relates to alcohol consumption and is intended for adults only. You must be at least 18 years old, or the legal drinking age in your country if higher, to use the app.
2. Important health notice — please read
Acuna is a personal self-tracking tool that helps you record and observe your own alcohol consumption. Acuna is NOT a medical device and does NOT provide medical, clinical, psychological, or professional advice, diagnosis, or treatment.
- Acuna does not diagnose, treat, cure, or prevent any disease or condition, including alcohol use disorder or dependence.
- The information Acuna shows (such as estimated grams of alcohol, calories, targets, and trends) is for general informational and self-awareness purposes only, is based on the data you enter and standard estimates, and may not be accurate for your individual circumstances.
- Acuna is not a substitute for the advice of a qualified doctor, therapist, or other health professional. Always seek the advice of a qualified professional with any questions you may have regarding alcohol use or your health.
- Never disregard professional advice or delay seeking it because of something in the app.
- If you are concerned about your drinking or think you may be dependent on alcohol, please speak to a healthcare professional or a specialist support service.
- If you are in crisis or believe you may be experiencing a medical emergency, contact your local emergency services immediately.
You use Acuna and make decisions about your alcohol consumption at your own discretion and risk.
3. Your licence to use the app
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use one copy of Acuna on Apple devices that you own or control, for your personal, non-commercial use, in accordance with the App Store Terms of Service. This licence does not transfer any ownership rights to you.
4. Your data is yours and stays on your device
Acuna stores the entries you create only on your device. We do not receive, store, or have access to your diary. This means:
- You are solely responsible for your data and for maintaining backups. If iCloud Backup is enabled on your device, your data may be included in your device’s normal Apple backup (controlled by you and Apple); otherwise it exists only on your device.
- If you delete the app, reset or lose your device, or your device’s backup is unavailable, your data may be permanently lost. Because we do not hold your data, we cannot recover it for you.

5. Free trial and purchase
Acuna is free to use for a limited trial period of 14 days. After the trial, continued use requires a one-time in-app purchase that unlocks the app permanently (“lifetime unlock”).
- Acuna’s paid unlock is a one-time purchase. It is not a subscription and does not renew automatically.
- Prices are shown in the app and may vary by country and currency, and may change over time; the price shown to you at the time of purchase applies to that purchase.
- All purchases are processed and billed by Apple through the App Store, subject to Apple’s terms. We do not process your payment details.
- Refunds are handled by Apple in accordance with App Store policies and applicable law. Requests for refunds should be made to Apple.
- Any additional optional features that may be offered in the future will be described at the point of sale.
Nothing in these Terms limits any statutory rights you may have as a consumer that cannot be excluded under applicable law.
6. Acceptable use
You agree not to: (a) copy, modify, or create derivative works of the app except as permitted by law; (b) reverse engineer, decompile, or attempt to extract the source code, except to the extent this restriction is prohibited by applicable law; (c) rent, lease, lend, sell, redistribute, or sublicense the app; (d) use the app for any unlawful purpose or in any way that could harm the app or others.
7. Intellectual property
The app, its content, design, and the “ACUNA” name and logo are owned by or licensed to Atlander and are protected by intellectual property laws. Except for the limited licence granted above, these Terms do not grant you any rights in our intellectual property.
8. Availability and changes
We may update, change, suspend, or discontinue the app or any of its features at any time, without liability, to the extent permitted by law. We do not guarantee that the app will always be available or error-free.
9. Disclaimers
To the maximum extent permitted by applicable law, the app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app’s calculations or information are accurate, complete, or suitable for your purposes. This section does not affect mandatory consumer warranties that cannot be excluded under applicable law.
10. Limitation of liability
To the maximum extent permitted by applicable law, Atlander will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of, or inability to use, the app. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable consumer law. Where our liability cannot be excluded but can be limited, it is limited to the amount you paid for the app.
11. Termination
These Terms apply until terminated. Your licence ends automatically if you fail to comply with them. You may end them at any time by deleting the app.
12. Governing law
These Terms are governed by the laws of Portugal, without prejudice to any mandatory consumer-protection rights you enjoy under the laws of your country of residence. Mandatory rights of consumers resident in the European Union are not affected.
13. Apple App Store — additional terms
The following additional terms apply because you obtained Acuna through the Apple App Store:
- These Terms are between you and Atlander only, not with Apple. Apple is not responsible for the app or its content.
- The licence granted to you is limited to use on Apple-branded devices that you own or control, as set out in the Usage Rules of the App Store Terms of Service.
- Apple has no obligation to provide any maintenance or support for the app. Any questions about the app should be directed to us at support@acuna.app.
- To the extent permitted by law, Apple has no warranty obligation with respect to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability claims, claims that the app fails to meet a legal or regulatory requirement, or claims under consumer-protection or privacy law.
- In the event of any third-party claim that the app or your use of it infringes intellectual property rights, Atlander (not Apple) is responsible for the investigation, defence, settlement, and discharge of such claim to the extent required by these Terms.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
